Legal basis is the Trademark Act of May 11, 1995 and the Regulations for the performance of the Trademark Law and the Taxation Law of the Office of Trademarks, dated December 28, 1995.Trademark protection is obtained by registration.

Nice Classification

Andorra's Trade Mark Law requires the designation of goods and services according to the Nice International Classification (contained in the Nice Agreement), using the codes established in the Alphabetical Classification foreseen by WIPO, following the mentioned classification. The designation of other goods or services with different coding requires the attachment of a Classification Report issued by WIPO with the corresponding translation into Catalan.

Requirements:  

  • Name and Address of Applicant(s)
  • Print of the mark,
  • List of Goods and/or Services and the classes
  • A non-legalized Power of Attorney  
  • A copy of the basic application, if priority is to be claimed

Procedure:

  • The application is filed at the Trademark Office (OMPA).
  • Applications can only be filed via an electronic device.
  • The application process includes a formal examination and an examination of distinctiveness. Afterwards, a certificate is issued and the registration is published electronically.
    Every 3 months, the OMPA publishes the “Gaseta” (CD-ROM).

Duration and Renewal: A trademark registration is valid for 10 years from the date of application.The registration is renewable for periods of 10 years. The grace period for renewals is 6 months after the due date.
