Algeria

Legal basis is the Decree No. 03-06 of July 19, 2003, in force since August 2, 2005. Algeria is a member of the Madrid Protocol since October 31, 2015.

Requirements:  

  • Name and Address of Applicant(s)
  • Print of the mark, List of Goods and/or Services and the classes
  • A non-legalized Power of Attorney for each applications.
  • A certified copy of the priority document. It must be submitted within a period of six months, in case it is claimed

Procedure:

  • The application is filed at the Algerian Institute of the Intellectual Property
  • The application process includes a formal examination and a full one, which further this latter either the registration certificate is issued or a provisional refusal of registration is issued with the indication of considered as possible identical or similar trademarks, and/or the examined trademark as a descriptive one.
  • After registration the trademark is published. Duly note, in Algeria there are no (national) provisions for filing opposition against a trademark registration before the Trademark Office. 
  • The approximate time frame for completing the registration process of a trademark is 15-18 months if there is no objection.

Duration and Renewal: A trademark registration is valid for 10 years and starts with filing registration date. The registration can be renewed every ten years.
