Belgium

Belgium belongs to the Benelux countries (Belgium, the Netherlands and Luxembourg) as they are members of the Madrid Agreement, of the Madrid Protocol and of the European Community. Duly note, since the Benelux Trademarks Act in 1971, there are no national trademark laws in any of the Benelux countries anymore. Trademark protection is obtained by registration.

Requirements:

    • Full details of the applicant and his representative (where applicable).
    • A representation of the mark.
    • A list of goods/services to be covered by the application.
    • Power of Attorney (POA)

Procedure:

    • Once a trademark application is filed, it will be published in the Trademarks Register for a period of two months during which interested third parties may file oppositions against the trademark application based on their prior rights.
    • At the same time, the BOIP will conduct a substantive examination to determine whether the application complies with the registration requirements. 
    • Provided there is no opposition, the mark is registered and a certificate of registration is issued which will be reflected in the trademark register.

Duration and Renewal: Trademark registration in Belgium - Benelux is valid for 10 years from the date of application after which it can be frequently renewed for another 10 years for unlimited number successive 10 years.
