Bulgaria

Bulgaria is a member of the Madrid Agreement and the Madrid Protocol and the European Community.Patent Law with the amendments in force as from 18 May 2012. Law on Marks and Geographical Indications of 15 December 1994.Law on Industrial Design of 15 December 1999.

Requirements:

  • Name and address of the applicant.
  • Representation of the mark, all digital formats are acceptable.
  • List of the goods and/or services assigned to the trademark, according to the International Classification of Goods and Services
  • Document of Priority (if priority is claimed).
  • Power of Attorney signed by the applicant, no legalization required.    

Procedure:                                                                                                                                          

  • The application for registration of the trademark shall be submitted at the Patent Office of Republic of Bulgaria 
  • Multiple class trademark applications are possible in Bulgaria.
  • Within two months from filing the application, the BPO subjects the application to a formal examination for compliance with the provision of the Marks and Geographical Indications Act.
  • Consequently, within three months of the conclusion of the formal examination, the BPO conducts Substantive examination (on absolute grounds only) for compliance of the mark
  • within one month of the conclusion of the substantive examination, it is published in the Official Bulletin of the BPO  for opposition .
  • If no opposition is filed, the applicant is notified to pay the necessary fees to effect the trademark registration in Bulgaria.
  • The trademark registration procedure set forth herein takes approximately 12 months to complete.

Duration and Renewal: The trademark in Bulgaria is registered for the period of 10 years starting from the date of filing.
