Legal basis is the Trademark Law, contained in the Andean Pact Decision 486 concerning industrial property, in force since December 1st, 2000.Colombia is a member of the Madrid Protocol and a member of the Andean Pact. According to the Andean Pact agreement, there are common rules in trademark law in all member states of the Andean Pact (Bolivia, Colombia, Ecuador, Peru).Trademark protection is obtained by registration.

Requirements:
- Details of the trademark owner (name, address, registration number).
- Certified copy of the certificate of incorporation or any equivalent document notarized and legalized up to the Colombian Consulate.
- Applicant’s domicile
- The trademark, indicating the products or services covered by the mark.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- If the client would like to claim Paris Convention Priority, the certified copy of the priority document is required (without any legalization). The legal term is of six (6) months as from the filing date of the foreign document.
- Power of Attorney. Power of attorney notarized and legalized up to the Colombian Consulate.
Procedure:
- The trademark application can be filed with the IP office.
- The application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks.
- After the approval in preliminary examination the trademark is published in the Chilean Official Gazette.The opposition period is within 30 days following publication.
- The trademark office will then issue the registration after the publication period if no objection was raised during that period.
- The processing time from first filing to registration is approx. 6- 12 months.
Duration and Renewal: A trademark registration is valid for 10 years from the date of registration. The registration is renewable for periods of 10 years.
