Estonia

Legal basis is the Trademark Act of October 1st, 1992, last redaction entered into force January 1, 2012.
Estonia is a member of the Madrid Protocol since November 18th, 1998. Since May 1st, 2004, Estonia has been a member of the European Union. 
 

Trademark registration classification:

 

Requirements:

  • Applicants name and address.
  • List of goods and services.
  • Engagement letter – copy of identification document is needed.
  • Power of Attorney - simple signed is sufficient.
  • Prints of the trade mark - word or logo. If logo, a .jpg file is needed.

Procedure:

  • A trademark application has to be filed before the Estonian Patent Office by a local agent.
  • After the completion of filing, the Official Notification of the receipt of the application is issued within 3-4 months.
  • Then the Estonian trademark application undergoes formal and substantive examinations.
  • On condition that the trademark meets the requirements of protectability the trademark is published in the Official Bulletin for two months.
  • In absence of opposition and in case the official registration paid the trademark is registered and the certificate is issued
  • The entire procedure of trademark registration in Estonia takes from 16 to 20 months
 

Duration and Renewal: A trademark registration in Estonia is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
