Greece

On April 11, 2012, a new trademark law (Law No. 4072/2012) came into force in Greece. Greece is a member of the Madrid Protocol and the European Union.Trademark protection is obtained by registration.

Requirements:

  • full details of the applicant, such as name and address.
  • List of goods to be protected and classification.
  • Power of attorney simply signed by the applicant.
  • samples of the trademark, if it is a device trademark.
 Procedure:
  • The application for registration of the trademark shall be filed in the Register of Trademarks by a local agent.
  • The application process includes a formal examination and an examination of distinctiveness, but no search for prior trademarks. 
  • If approved by the Examiner, the trademark is published in the Industrial Property Official Gazette for opposition.
  • The opposition period is 5 months from publication date of the application.
  • If no opposition is filed against the registration of the trademark within a period of five months after the publication date, the trademark is then automatically registered and the registration date is recorded in the Trademarks Book. 

Duration and Renewal: A trademark registration in Greece is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
