Requirements:

  • Name and Address of Applicant(s).
  • Print of the mark, List of Goods and/or Services and the classes.
  • A power of attorney authenticated by a consulate of Honduras or by Apostille is necessary.
  • Certificate of incorporation or extract from the commercial register legalized by the Honduran Consulate.
  • The priority document issued by the competent autority, if you wish to claim trademark priorities. 

  Procedure:

  • A trademark application has to be filed before the Patent Office by a local agent.
  • The application process includes a formal examination and an examination of distinctiveness, but no search for prior trademarks.
  • Publication on the Official Gazette within 18 months from the application. From this moment, a 90 days period for oppositions is opened.
  • The opposition period is 1 month from publication date of the application.
  • Time from filing to registration: 12 months.

Duration and Renewal: A trademark registration in Honduras is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
