Jamaica

In Jamaica, the legislation dealing with trademarks is the Trademarks Act (32/1999 and 25/2001), the Trademarks (Amendment) Act (17/2013) and the Trademarks Rules 2001 (as amended in 2011 and 2013).

Requirements:

  • Name and address of the applicant.
  • State or country of incorporation.
  • Representation of trademark (a depiction of the mark an applicant seeks to register).
  • List of goods/services.
  • Power of attorney simply signed.
  • Confirmation of use of the trademark in Jamaica.
  • Certified copy of the priority document if claimed, with verified English translation.
  • If the applicant is not domiciled in this jurisdiction, a local address for service must be provided

Procedure:

  • The trademark application is filed before the Jamaica Intellectual Property Office (JIPO).
  • The Registrar will then examine whether the application satisfies the requirements of the Act and will also conduct a search to determine whether the mark is similar or identical to any earlier marks.
  • If the Registrar is not satisfied, you will get a minimum of thirty (30) days within which to respond and/or amend the application. If the Registrar is satisfied, then the application will be accepted and you will be notified.
  • Thereafter, the application will be published in the Gazette to give members of the public an opportunity to oppose your application.
  • If no opposition is received, the Registrar will register the mark and issue a Certificate of Registration.
  • It takes approximately 12-18 months from first filing to registration. 

Duration and Renewal:A trademark registration in Jamaica is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.
