Legal basis of the Italian trademark legislation is the Code of Industrial Property Rights which entered into force on March 2005 and was slightly amended in 2010. It replaced the Trade Marks Act in force since January 1993, amended 1999. Italy is a member of the Madrid Agreement, the Madrid Protocol and the European Union.

Requirements:
- Name and address of applicant.
- An indication of the trademark or a specimen, if the mark includes colors or graphic elements
- List of goods and/or services
- Legalization or notarization of the Power of Attorney is not required. It may be provided within two months from filing the Italian Trademark application.
Procedure:
- Trademark applications to be filed at the Italian Patent and Trademark Office (IPTO).
- A first formal and technical exam is conducted by the UIBM (Italian Patent and Trademark Office), which checks that the application meets the formal requirements.
- If all the requirements are met then it is published in the Official Trademark Gazette for the opposition.
- Opposition can be filed to the registration with the UIBM within 3 months as from publication date.
- If no one files opposition the trademark is granted.To the trademark a grant number and date will be assigned and the holder will be able to obtain the relative certificate of registration.
- It takes approximately 12-24 months from first filing to registration.
Duration and Renewal: A trademark registration in Italy is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years starting from the first application date.
